1801年至1835年是美国独立后联邦最高法院发展的一个重要阶段。在此之前,联邦最高法院已运行十年,历经三任首席大法官(分别是约翰·杰伊,约翰·拉特利奇,奥利弗·埃尔斯沃斯),但联邦最高法院的作用非常有限,及至1801年约翰·马歇尔就任首席大法官,最高法院与后来相比只是徒有其表。而当马歇尔于1835年去世时,最高法院已经转化为一个与立法部门和行政部门平等的机构,拥有维护宪法之舟的最终权威。本著作拟将美国联邦最高法院置于早期国家建构的历史进程中,力图考察最高法院特别是马歇尔法院在美国宪政制度完善过程中所做出的诸多努力,客观分析马歇尔及其马歇尔法院其他大法官的政治法律思想和司法实践,揭示其在美国最高法院地位的提升和早期宪政演进中的作用。
